To all OAIRP Members:
The following is a Notice to the Profession from the London Bankruptcy Court.
We hope you are all safe and well!
We have a few updates regarding Bankruptcy Court going forward. Filings prior to this email do not apply.
The Hearing Request Form, which I have attached is important for us to have along with your documents so please ensure you are filling it out fully. We will be rejecting materials if it’s not completely filled out. However, please input the date you are requesting. We DO NOT CONFIRM the date. Unless we indicate otherwise, the date you ask for is the date we will schedule. You MUST send ALL your materials along with this form.
Hard-copies of the materials are no longer required. However, the fees must be sent VIA regular mail to the London Courthouse, paid to the Minister of Finance.
In Writing/Basket Matters
All on consent or unopposed matters are being done via basket, as per usual. Please file materials by emailing us at londonbankruptcy@ontario.ca. These basket matters will continue to be heard on the days we have hearings. The dates for the rest of the year are attached to this email. Please have all documents, baskets or regular hearings, within seven (7) days before the hearing date. Matters received after such date will be held until the following date.
Opposed or Not on Consent matters
All matters that are being opposed or that are not on consent will be heard on our regular Bankruptcy list. We do not require a Confirmation of Motion form for Bankruptcy Court.
A Confirmation of Motion is only required for the matters that are on the Civil Motions list; please ensure the confirmation is sent to London.SCJ@ontario.ca as per the Rules of Civil Procedure.
REMINDERS:
- Only book a court date for a Taxation when you have the Comment Letter. These will not be signed without the Comment Letter.
- The protocol for naming documents when filing is also attached. Please follow this guide on how to name your documents or they will be rejected.
- Also please ensure you are attaching each document as separate attachments when filing materials.
- We have attached the Zoom link. This is static, and thus, is the same for every hearing (unless otherwise noted).
OR you can access the Court Docket on the Middlesex Law website at https://www.middlaw.on.ca/#docket and it is available after 4:00 p.m. the day before the hearing.
- Please provide Draft Orders for signature.
- Please also provide a filled-out Disposition Sheet with the name of Bankrupt, File number and date of hearing.
- Please put the Bankrupt’s name and file number in the subject line of the email.
